Terms of Service

These Terms of Service ("Terms") govern your use of Marka, operated by Devino Solutions Inc. ("Marka", "we", "us"). By creating an account or using Marka, you agree to these Terms.
1. The Marka marketplace
Marka is a peer-to-peer marketplace that connects buyers and sellers of goods. Marka provides the platform; sellers are solely responsible for the accuracy of their listings, the condition of items sold, and fulfillment of orders.
2. Accounts
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials. Provide accurate information during registration. One person may not operate multiple accounts.
3. Seller obligations
- Complete Stripe identity and payout verification before enabling checkout.
- List only items you own and have the right to sell.
- Accurately describe item condition, quantity, and shipping terms.
- Fulfil orders promptly upon confirmed payment.
- Not list prohibited items (see Section 7).
4. Buyer obligations
- Pay promptly upon committing to a purchase.
- Communicate in good faith with sellers regarding pickup, shipping, or item questions.
- Not file fraudulent chargebacks or dispute legitimate transactions.
5. Fees
Marka charges 0% marketplace fee on all sales. Sellers receive 100% of the sale price less Stripe's standard processing fee (approximately 2.9% + CA$0.30 per transaction). Paid plan features are billed as described on the Pricing page.
Taxes. Prices shown on Marka do not include tax, and Marka does not calculate, collect, or remit sales tax on any transaction. The seller is the merchant of record for their sales and is solely responsible for determining, collecting, and remitting any applicable taxes (including GST/HST, PST, QST, and any equivalent obligation outside Canada). Buyers should treat listed prices as tax-exclusive.
6. Payments
Card payments are processed by Stripe and paid directly into the seller's connected Stripe Standard account. Marka does not hold, pool, or delay seller funds. Cash transactions are between buyer and seller directly; Marka has no liability for cash transactions.
7. Prohibited listings
The following are prohibited on Marka: firearms and regulated weapons; controlled substances; stolen, counterfeit, or infringing goods; live animals; items illegal under Canadian federal or provincial law; sexually explicit material involving minors; and any item Marka determines in its sole discretion to be harmful to users or the platform.
8. Disputes
Buyers disputing a card transaction should first contact the seller. Unresolved disputes may be escalated to Marka at support@joinmarka.com. For card payments, Stripe's chargeback process applies. Marka provides transaction logs to support legitimate dispute claims.
9. Limitation of liability
Marka is a marketplace platform. We are not a party to transactions between buyers and sellers. To the fullest extent permitted by law, Marka's liability for any claim arising from use of the platform is limited to the fees paid to Marka in the three months preceding the claim.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions.
11. Changes to Terms
We may update these Terms from time to time. Continued use of Marka after changes constitutes acceptance. We will notify registered users of material changes by email.
